In-house contracts subject to extended transition period

The changes to the Act on Public Procurement and Concession Contracts entered into force on 18 June 2026. A contracting entity must terminate the contract it has concluded with its in-house entity structured as a limited liability company before the entry into force of the Act with effect no later than 30 June 2027 if the requirement laid down in section 15(2) of the Act on Public Procurement and Concession Contracts for the use of the in-house entity is not met. If the termination of the contract concluded with an in-house entity before the entry into force of the amendments to the Act on Public Procurement and Concession Contracts would exceptionally have unreasonable consequences or the termination of the contract would be associated with significant financial risks, the contract may for compelling reasons arising from the public interest be terminated with effect no later than 30 June 2030. The contracting entity had to submit a notice of such a contract to the State Treasury by 30 September 2026. Instructions for submitting the notice were available on the website of the State Treasury. No new notices or changes to already submitted notices will be accepted after the deadline. However, the information displayed in the online service incorrectly for technical reasons can also be corrected after the end of the notification period.
